Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of any Ooma equipment or services. By using any Ooma product or service, you represent and warrant that you and your End Users will at all times comply with Ooma’s AUP. Any terms not defined herein have the meanings specified in the Ooma terms and conditions applicable to your purchase or use. Ooma reserves the right to terminate the Services and charge applicable usage and service fees at any time if it concludes you or your End Users are in violation of Ooma’s AUP.

  1. Prohibited Acts. The following are prohibited uses of Ooma Equipment and Services:
    1. resale, sublicensing, distribution, export, import, or transfer without the advance written permission of Ooma;
    2. use of any Ooma mark or Ooma’s third party providers’ marks without the advance written permission of Ooma;
    3. modifying, tampering, hacking, reverse-engineering, decompiling, disassembling, or creating derivative works;
    4. bundling, repurposing, or repackaging as part of any commercial service or application distributed to others;
    5. using in a manner designed to, or with the effect of, avoiding applicable fees or service charges;
    6. interference with services, including interference with other users or network equipment;
    7. allowing any third party to use any software commands for maintenance or repair of any software or hardware;
    8. interception, monitoring, modification, or redirection of any communication or data used by Ooma;
    9. causing any Ooma product to connect to any computer server or other device not authorized by Ooma;
    10. circumvention (or attempted circumvention) of technological or safety measures employed to control user access;
    11. any use that would violate applicable law or regulation, including any fraudulent, malicious, deceptive, dishonest, abusive, obscene, threatening, harassing, tortious, improper, defamatory, libelous, slanderous, or indecent use;
    12. use to impersonate another person with fraudulent or malicious intent;
    13. misuse of the Ooma Services by “spamming” or sending abusive, unsolicited, or other mass automated communications;
    14. use of the Ooma Equipment and Services with applications designed for unattended use, automatic data feeds, connections, or applications that are used in a way that degrades network capacity or functionality;
    15. use of voice or data exceeding the amount provided by your service plan;
    16. use of server devices or host computer applications or other systems that drive continuous, heavy traffic or data sessions or automatically consume unreasonable amounts of network capacity;
    17. continually or repeatedly dialing numbers associated with free conference calls, free chat lines, or similar services;
    18. unauthorized, wrongful, or misappropriated use of services (including cloning, compromised SIM algorithm, and subscription fraud) on a MSISDN or SIM assigned to you, whether or not the MSISDN or SIM is currently active;
    19. using the service without permission on a stolen or lost device;
    20. installing any amplifiers, enhancers, repeaters or other devices that modify or otherwise affect the radio frequencies used to provide services without express permission from Ooma;
    21. monitoring of third parties without their permission, including location-based tracking of individuals;
    22. using the service to provide life-sustaining medical care or monitoring;
    23. use of data services in a manner that is unlawful or unduly interferes with the use of third-party networks;
    24. disruption of e-mail use by others using automated or manual routines, including “auto-responders” or cancel bots;
    25. all activities adversely impacting the ability of other people or systems to use either the third-party cellular data network or other parties’ internet-based resources;
    26. if your Services require the use of Teal, violation of the terms and conditions found at https://www.ooma.com/teal/.
    27. violation of any other applicable acceptable use policies of third parties;
    28. harvesting or collecting of information about others, including personally-identifiable information, without consent;
    29. transmission, upload, distribution, or storage of any material viruses, malware, or other harmful materials;
    30. violating the foreign or domestic intellectual or proprietary rights of Ooma or any other party;
    31. violating the right of privacy, personality, or publicity of any party;
    32. any other use that interferes with Ooma’s ability to provide products or services to other customers;
    33. moving any provided SIM card to another device without the advanced written permission of Ooma; and
    34. any other use that is unethical, fraudulent or harmful or assists others in any unethical, fraudulent or harmful scheme.
  2. SIM Cards. By activating any SIM card we provide you, you agree that we or the applicable third-party provider:
    1. own all intellectual property and software on the SIM card;
    2. may change the software or other data on the SIM card remotely and without notice; and
    3. may utilize any capacity in the SIM card for administrative, network, business and/or commercial purposes.
  3. User Responsibility for Content. You understand and agree that we have no control over the Content that you access on your Equipment or Services. You are solely responsible for evaluating the Content accessed by you or anyone through your Equipment or Services. Content may be (i) unreliable or inaccurate; (ii) offensive, indecent, or objectionable; and/or (iii) unsuitable for children or minors. Content from third parties may harm your Equipment or its software. We are not responsible for any Content or any damage caused by any Content that you access with or load onto your Equipment or Services. Content stored on any Ooma Equipment or Services, transmitted over third-party networks, or stored by Ooma may be deleted, modified, or damaged.
  4. Ooma AirDial. In addition to the prohibited acts outlined herein, the following uses of Ooma AirDial are prohibited:
    1. use of AirDial equipment for voice applications if your service plan does not provide for it;
    2. using equipment modified outside of Ooma’s permitted specifications or otherwise beyond its intended use;
    3. subscription to AirDial Service for personal or household use or if you are eligible to participate in any Universal Service Fund program (i.e., E-Rate, Rural Health Care, or other programs); and
    4. subscription to AirDial for business use without a Federal Tax ID or without being listed as a sole proprietorship.
  5. Managed Wi-Fi®: In addition to the prohibited acts outlined herein, users of Ooma Managed Wi-Fi®are further prohibited from (i) using an Ooma Managed Wi-Fi® Access Point as a general SQL server; (ii) removing any proprietary labels or notices on an Ooma Managed Wi-Fi® Access Point; and (iii) placing a disproportionate load on an Access Point so as to interfere with its operation.
  6. Abuse of Calling Plans. Residential customers must use their Equipment and Services for domestic, non-commercial use only. Ooma Office customers must use their Equipment and Services only in a manner consistent with reasonable, small business use. Unlimited voice calling is intended for continuous, live conversation between two individuals. Lack of continuous conversation, unusual calling patterns, excessive caller and calling destinations and/or excessive usage (e.g. 5,000 minutes per line of service per month or more) will be considered as indicators that your use of Equipment may be inconsistent with Ooma’s usage limits. It may also indicate that the Equipment is being used in a manner not allowed by your Service plan and may result in review of your account and usage history. Failure to contact Ooma in response to our notification and/or failure to bring usage levels to normal levels in a timely fashion will result, in Ooma’s sole discretion, in immediate transfer to a service plan and fee schedule consistent with your actual usage rates. You acknowledge that if Service to your Equipment is terminated for abnormal usage patterns, you are subject to all applicable usage and service fees for the time periods in which your use of the Equipment was inconsistent with its allowable usage.
  7. Recording and Transcription. Certain Ooma products and services, including without limitation Ooma Telo, Ooma Meetings, Ooma Office, and Ooma Enterprise, record and/or transcribe your communications with third parties, including inbound or outbound calls, video conferences, and voicemails. By using any Ooma Equipment and Services, you acknowledge and agree that (i) there are laws and regulations, varying by jurisdiction, that may require you to provide notice of, and receive affirmative consent regarding, your recording or transcription of audio or video communications; (ii) you will at all times comply with such laws and regulations; and that (iii) Ooma shall have no liability to you or any third-party arising from your recording or transcription of communications. Ooma does not warrant the accuracy of any recording or transcriptions as several factors including poor audio quality, use of uncommon jargon, and intelligibility are outside Ooma’s control. Users of Ooma Meetings will receive a notification whenever a host enables recording. If a meeting participant does not consent to being recorded, the only recourse is to leave the meeting.
  8. International Use. The Ooma Equipment and Services are designed for use in Canada Ooma cannot guarantee installation, performance, or use of Ooma Equipment and Services outside Canada and reserves the right to suspend Service to any non-Canada based system at any time. If you install or use the Ooma Equipment or Services outside of Canada, you are solely responsible for any violation of any applicable law or regulation, including export laws, tax laws, tariff agreements, or foreign internet provider terms of service. You are solely responsible for any taxes, fees, penalties, or surcharges associated with use of the Ooma Equipment and Services outside of Canada
  9. Export Controls. You will fully comply with all relevant import and export laws, conventions, and regulations imposed by federal, provincial, local, or applicable international laws. You expressly agree not to export, re-export, distribute, transmit, or otherwise transfer any portion of your Equipment or Services to any destination, company, or person restricted or prohibited by such laws.
  10. Copyright & DMCA Notice: Materials may be made available via the use of the Equipment and Services by third parties not within Ooma’s control. Ooma is under no obligation to review content posted, published, or broadcast through the Services for illegal or impermissible content. However, Ooma respects the copyright interests of others. Ooma does not permit materials known by it to infringe another party’s copyright to be posted, published, or otherwise broadcast through our Services. If you believe any of the materials infringe a copyright, you should provide Ooma with written notice including: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing and information reasonably sufficient to permit Ooma to locate the material; (d) information reasonably sufficient to permit Ooma to contact the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material is not authorized; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
