Voice and Messaging Terms

These Voice & Messaging Terms govern your use of any Ooma voice or messaging services. Capitalized terms not defined herein have the meaning ascribed to them in the terms and conditions applicable to your purchase or use of Ooma products and services.
- Number Assignment. Phone numbers are either assigned by Ooma or (where permitted) chosen by Customer. If your phone number is not in your local calling area, others in your local calling area may incur charges when calling you and toll charges may be different than those assessed on your former number. Ooma reserves the right to change your phone number(s) when reasonably required. Changes to residential phone numbers are subject to processing fees. Please see https://www.ooma.ca/legal/rates/ for Ooma’s current rates. Assigned numbers are unique to Equipment and transfer with the sale of any Equipment. Ooma reserves the right to re-assign phone numbers attributable to Equipment that you de-activate or fail to use for a commercially unreasonable period of time, or in the event that you are assigned a backup number pursuant to a free trial and your trial does not convert into a paid subscription.
- Porting. Ooma will use reasonable efforts to port Customer phone numbers but cannot guarantee that any particular number may be ported. Number transfers for residential customers are subject to a one-time porting fee. Please see https://www.ooma.ca/legal/rates/ for Ooma’s current rate. Ooma will not be responsible for porting numbers not provided to Ooma prior to or reasonably in advance of service activation. You should allow up to 21 days, or longer depending on your provider, for porting to be completed, and should not cancel your existing phone service until porting is completed. Following service termination, Ooma will not be able to port out any of your assigned numbers unless you (i) provide Ooma with at least 30 days’ notice of your intent to terminate your services and port out your number, (ii) promptly complete all documentation required by Ooma’s carrier and your new service provider’s carrier to effectuate a number transfer, (iii) paid Ooma for all taxes, fees, and charges accrued by you prior to the effective date of your termination; and (iv) pay any porting fees charged by Ooma. Porting is provided through third parties outside of Ooma’s control and Ooma will not be liable to you for any damages concerning the availability of porting, delay, error, or failure of number transfers.
- Security. You are solely responsible for selecting, implementing, and maintaining security features protecting against unauthorized calling and messaging, such as firewalls and passwords. You must notify Ooma promptly if you become aware of fraudulent or unauthorized use of your account. Ooma will not be liable for any damages resulting from any such fraudulent or unauthorized use. The payment of all charges accrued against your account is and remains your sole responsibility.
- Reasonable Use Limitation. Ooma reserves the right to terminate your Services or modify your pricing if your use of Ooma’s Services, including any unlimited plans, exceeds Normal Use. As used herein, “Normal Use” means a use pattern similar to the use patterns of at least 95% of Ooma customers on the same or substantially similar service plan. Uses exceeding “Normal Use” include:
- an excessive amount of consecutively terminated and re-initiated calls, resulting in excessive call lengths;
- an excessive amount of inbound domestic toll-free calling patterns during a month;
- abnormal calling or messaging patterns indicative of an attempt to avoid Ooma’s reasonable use limitations;
- sending or receiving an excess of 500 pages of paperless facsimile per month;
- residential voice usage exceeding 5000 minutes per Equipment per month;
- calls that result in atypical termination costs or surcharges, including “free” chat and conference services; or
- a prohibited use specified herein.
- Prohibited Uses. The following uses of Ooma Services are expressly prohibited and constitute a breach of your terms of service:
- use of devices or any other methodology to circumvent use limitations or otherwise abuse a service plan;
- intentionally transmitting junk or spam advertisements or other junk or spam communications;
- intentionally engaging in blasting or other broadcasting of advertisements or other communications;
- any illegal use of auto-dialing, predictive dialing, sequential dialing or similar dialing pattern(s);
- engaging in or allowing trunking or forwarding of your Ooma telephone or facsimile number to another capable of handling multiple simultaneous calls, or to a private branch exchange (PBX) or key system;
- transmitting misleading or inaccurate caller ID information or email/SMS address or header information;
- violating any applicable law or regulation, including the Telephone Consumer Protection Act, the Junk Fax Prevention Act, and rules governing the DoNotCall Registry; or
- intentionally transmitting SMS or MMS content, in any manner that violates the terms of service of applicable third-party providers or applicable industry guidelines, including those issued by the CTIA or Campaign Registry.
- Blocking Calls. Without limiting its right to terminate, Ooma may block toll calls or charge Customer for reimbursement of associated charges if such calls result in atypical termination costs or surcharges, including calls to “free” conferencing or call management services, chat services, 900 numbers or the international equivalent, or recorded messages (such as those promoted in connection with reality TV shows, radio contests, or celebrity-sponsored recordings).
- Service Limitations.
- Voice-to-Text. Customer is responsible for verifying the accuracy of any voice-to-text conversions made through Ooma Services, as Ooma does not warrant such conversions will be error-free. Certain Services may also require human-aided conversions, meaning that the privacy of the converted messages cannot be guaranteed. Customer releases Ooma and any applicable third-party providers from any liability arising out of Customer or End User use of conversion services
- May Not Support x11 Calling. Ooma Equipment, if not connected to a landline, may not support 311, 511 and/or other x11 services other than certain specified dialing services such as 411, 711, and 911. 911 services are subject to the service limitations and other disclosures set forth in Ooma’s E911 Terms and Disclosures and your terms of service.
- No 0+ or Operator Assisted Calling. If not connected to a landline, Ooma equipment does not support 0+ or operator assisted calling (including third-party billing calls, 900, or calling card calls).
- Directory. Any phone numbers assigned to you by Ooma will not be listed in any public telephone directories.
- Calling Area. Calling within the United States does not include international calls, or calls to the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, Guam, the Virgin Islands, American Samoa, Wake Island, the Midway Islands, Kingman Reef, Johnston Island, Canada and certain other locations within the North American Numbering Plan area, nor do they include calls to content providers (e.g., 900, 976), premium services (such as 411) or operator assisted calls (such as 0+, 00+). Calls within Canada do not include calls to the Northwest Territories or Yukon. Regardless of the calling area, Ooma may choose to block toll calls or charge the customer for reimbursement of charges associated with calls if such calls result in atypical termination costs and/or surcharges, including, but not limited to, calls to “free” phone conferencing services, “free” call management services, phone chat services, 900 numbers or the international equivalent of any of the foregoing, or recorded messages (such as those promoted in connection with reality TV shows, radio contests, or celebrity-sponsored recordings). Your ability to continue to make calls is contingent upon your continuing to subscribe to a High-Speed Internet service or subscribing to Cellular Service to enable calling over a third-party cellular data network.
